TERMS OF SERVICE

1. Acceptance of Terms
By accessing or using AutoViz LLC (“AutoViz,” “we,” “our,” or “us”) services, including our website, embedded visualization tools, augmented reality features, AI-powered image processing tools, and iOS App Clip (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).
2. Description of Services
AutoViz provides 3D visualization, product configurator, augmented reality, and AI-generated simulation tools for automotive brands and retailers. AutoViz does not manufacture, sell, or distribute physical products and does not guarantee product fitment or performance.
3. Embedded Services
AutoViz tools may be embedded on third-party retailer or brand websites (“Client Sites”). Client Sites are independently operated. AutoViz is not responsible for the content, policies, or practices of Client Sites. When embedded, AutoViz generally acts as a service provider to the Client Site operator.
4. User Content and Image Uploads
Users may upload images to utilize AI-powered visualization features. By uploading content, you represent that you have the legal right to use and submit such content. You grant AutoViz a limited, non-exclusive license to process uploaded content solely to provide the Services.
AutoViz does not claim ownership of user-uploaded images. Users are responsible for ensuring that uploaded content does not infringe intellectual property rights or violate applicable law.
5. Generated Content Disclaimer
Images and visualizations generated by AutoViz are simulations for illustrative purposes only. They may not accurately represent real-world product specifications, dimensions, fitment, or performance.
6. Prohibited Uses
You agree not to use the Services to:
- Upload unlawful, infringing, or harmful content
- Attempt to interfere with system security or integrity
- Reverse engineer or copy proprietary technology
- Use the Services for unauthorized commercial exploitation
7. Intellectual Property
All software, technology, trademarks, logos, and proprietary materials provided by AutoViz are owned by AutoViz or its licensors and are protected by intellectual property laws. No rights are granted except as expressly stated.
8. Data and Privacy
Use of the Services is also governed by our Privacy Policy. By using the Services, you acknowledge and agree to the practices described therein.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.” AutoViz disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, AutoViz shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or business interruption. In no event shall AutoViz’s total liability exceed the amount paid (if any) for access to the Services within the preceding twelve (12) months.
11. Indemnification
You agree to indemnify and hold harmless AutoViz from any claims, liabilities, damages, or expenses arising out of your use of the Services or violation of these Terms.
12. Termination
AutoViz may suspend or terminate access to the Services at its discretion if these Terms are violated or if necessary to protect system integrity or legal compliance.
13. Modifications to Services or Terms
AutoViz may modify or discontinue portions of the Services at any time. We may update these Terms periodically, and continued use constitutes acceptance of any updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which AutoViz LLC is organized, without regard to conflict of law principles.
15. International Use
The Services are intended primarily for use in North America. Users accessing the Services from other jurisdictions do so at their own initiative and are responsible for compliance with local laws.
